休閒農場的定義

休閒農場定義為經營「休閒農業」之「場地」,而休閒農業則指利用田園景觀、自然生態及環境資源,結合農林漁牧生產、農村文化及農家生活、農業經營活動,提供國民休閒、增進對農業及農村體驗為目的的農業經營。

 

申辦休閒農場的原則

想要申辦休閒農場應具有農林漁牧生產事實,且休閒農場未來必須有60%以上農林漁牧生產區域。

簡單說經營休閒農場必須實際營業及具有生產的能力,且農林漁牧用土地面積不可以少於60%。

休閒農場的類型

休閒農場可分為「綜合型」及「簡易型」,申辦綜合型休閒農場土地面積要求大,加上涉及土地變更,所需文件多且時長久,適合財團及政府單位。而相比下簡易型休閒農場土地面積要求較小,申辦容易且快速,適合一般民眾。

兩者資料準備只差在「興辦事業」卻影響甚大,因綜合型閒農場涉及用地變更,調查、準備環境影響評估及水土保持計畫書可能就要花上約2-5年的時間呦。

簡易型與綜合型休閒農場的規範差別?

申請面積

簡易型(又稱體驗型休閒農場)

  • 坐落土地於休閒農業區範圍「外」不得小於1公頃。
  • 坐落土地全部於休閒農業區「內」、離島地區,不得小於0.5公頃。
  • 農業用地占全場總面積不得低於90%

綜合型(可以興建用地變更項目休閒農業設施)

  • 於休閒農業區範圍「外」非山坡地農業用地土地面積需達2公頃以上。休區「外」山坡地,「都市土地」面積需達2公頃以上,「非都市土地」需達10公頃以上。
  • 於休閒農業區「內」非山坡地面積需達1公頃以上。休區「內」山坡地,「都市土地」面積需達1公頃以上,「非都市土地」需達10公頃以上。
休閒農業區是由直轄市、縣 (市) 主管機關依據各地區農業特色、景觀資源、生態及文化資產,規劃休閒農業區,報請中央主管機關劃定。 實際規定以政府最新規定為準

籌設期間

簡易型(又稱體驗型休閒農場)

  • 自核發籌設同意4年內須完成並取得休閒農場許可。(依同意函日期起算)

綜合型(可以興建用地變更項目休閒農業設施)

  • 自核發籌設同意4年內,如無法完成經主管機關同意可展延2年,可展延2次,最長籌設期間有8年。
獲得籌設同意後要在期限內建造完成,並獲得休閒農場許可證,否則視同無申請呦。

第一步:到農業易遊網網站首頁,找到欄位上方「公開資訊」,並在清單中點擊「休閒農場申請系統」。

第二步:於休閒農場申設管理與查核作業系統畫面中,右上方欄位點擊「籌設申請」。

第三步:確認需要的申辦文件及證件。

第四步:再次確認申請流程後勾選「已閱讀」,並點擊下方「申請籌設」。

第五步:開始正式申請啦!

注意事項

在申辦休閒農場之前一定要確認以下事項:

1.確認土地區位:非都市土地、都市計畫範圍土地、國家公園土地?
2.土地所有權人:公有、私有、同意書公證(例如:租賃,若是土地是有租賃的,最好是上法院公證才有保障)
3.休閒農場申請類型:簡易型、綜合型(注意面積是否符合規範)

Principles for applying for a leisure farm

It is suitable for consortiums and government units. In contrast, simple leisure farms require smaller land area, are easy and fast to apply for, and are suitable for the general public.

The only difference in data preparation between the two is “building a business”, but the impact is huge. Since the comprehensive leisure farm involves land use changes, it may take about 2-5 years to investigate and prepare environmental impact assessments and soil and water conservation plans.

What are the standard differences between simple and comprehensive leisure farms?
Application area
Simple type (also known as experiential leisure farm)

The land located “outside” the recreational agricultural area shall not be less than 1 hectare.
The land located entirely within the leisure agricultural zone or outlying island area shall not be less than 0.5 hectares.
Agricultural land shall account for no less than 90% of the total area of ​​the site
Comprehensive type (can build recreational agricultural facilities in land use change projects)

The land area of ​​non-hillside agricultural land “outside” the scope of the leisure agricultural area must be more than 2 hectares. For the hillside land “outside” the rest area, the “urban land” area needs to be more than 2 hectares, and the “non-urban land” needs to be more than 10 hectares.
The area of ​​non-hillside land “within” the recreational agricultural area must be more than 1 hectare. For hillside land “inside” the rest area, the “urban land” area needs to be more than 1 hectare, and the “non-urban land” needs to be more than 10 hectares.
Leisure agricultural areas are planned by municipal and county (city) competent authorities based on the agricultural characteristics, landscape resources, ecological and cultural assets of each region and submitted to the central competent authority for delineation. Preparatory period
Simple type (also known as experiential leisure farm)

It must be completed and a leisure farm license must be obtained within 4 years from the issuance of the establishment consent. (Based on the date of consent letter)
Comprehensive type (can build recreational agricultural facilities in land use change projects)

Within 4 years from the issuance of the preparatory agreement, if it cannot be completed, it can be extended for 2 years with the approval of the competent authority. It can be extended 2 times. The maximum preparatory period is 8 years.
After obtaining the approval of the establishment, the construction must be completed within the time limit and a leisure farm license must be obtained, otherwise it will be deemed that there is no application.
